Major Victory: Human Gene Patents Struck Down; Movement Maker Sandra Park One of Lead Attorneys in Case
Should companies be able to patent human genes? Today, the U.S. Supreme Court answered that profound question with a resounding NO. Sandra Park, Senior Staff Attorney at the Amercian Civil Liberties Union, was a lead attorney in the case. Sandra and her colleagues began studying the issue several years ago, and then filed the case in 2009 on behalf of 20 courageous plaintiffs. The Supreme Court issued a unanimous decision concluding that human genes cannot be patented. The decision overturned 25 years of Patent Office practice of approving patents on thousands of human genes – including BRCA1 and BRCA2, the two genes at the heart of the case that are connected to hereditary breast and ovarian cancer.
